The Botswana Council of Non-Governmental Organisations (BOCONGO) has issued a strong condemnation of the proposed Bill No. 20 of 2024, which seeks to amend Section 3 of the Referendum Act, granting the President unilateral powers to call for referendums on matters not explicitly outlined in current legislation.
In a press statement released recently, BOCONGO expressed deep concern over the implications of this proposed amendment, particularly in the context of Botswana’s ongoing Constitution review process. The amendment, as published in the Government Gazette Vol LXII, No. 96, has raised alarms within civil society regarding potential infringements on democratic principles and the balance of governmental powers.
This criticism comes amidst recent remarks by the Minister for State President, Honourable Kabo Neale Sechele Morwaeng, who, on Saturday evening, 3rd August 2024, announced the withdrawal of three other bills during a televised address on BTV. Minister Morwaeng emphasized the importance of participatory democracy and public engagement in governmental decision-making processes.
However, BOCONGO contends that the proposed Referendum Amendment Bill contradicts these principles, echoing concerns previously raised about the Constitution (Amendment) Bill No. 4 of 2024. This pattern, according to BOCONGO, reflects a troubling trend of centralizing power within the presidency, contrary to the desires of the Batswana people.
“We are deeply concerned that granting the President unilateral powers to call referendums on unspecified matters further erodes the democratic fabric of our nation,” remarked a spokesperson for BOCONGO. “This move risks sidelining public input and diluting the principles of good governance and democratic accountability.”
BOCONGO has called upon the government to prioritize comprehensive and inclusive public consultations on all matters pertaining to constitutional reforms and significant legislative changes. They urge swift action to ensure that the voices of Batswana are heard and respected in shaping the future of their democracy.
