Botswana Law Society to investigate Collins Newman Law firm

The Law Society of Botswana will make an enquiry and investigate a case in which Collins Newman Law firm has admitted to fraudulent filing of a case in which they were representing Bank of Botswana. 

Law Society President, Lawrence Lecha revealed that the society has the power to investigate and take action against the law firm if any offences of misconduct can be established after all the proceedings on the matter.

”We are alive to the fact that the law firm has issued a press release to the media in relation to investigating one of their employee who was handling the matter. We will wait for a full judgment and study it and wait to see if the law firm will appeal the matter.

We shall take the matter from there and see if they are guilty of any misconduct or not and take appropriate decision on the issue,”said Lecha. Lecha said the society is alive to the matter and they will make their own assessment on whether there is a need for any disciplinary action against the law firm and its lawyer.

He said the society’s disciplinary committee has the power to investigate such issues even if the matter was not reported to them.

It is on court records that Collins Newman and Company admitted blame after the case was filed with the High Court.

The allegations of forgery against Collins Newman and the Bank of Botswana (BoB) emerged after the reserve bank approached the High Court in a bid to stop EBC Guernsey (Creditors of failed Kingdom Bank) from attaching its property to reclaim a P27 million debt arising from the winding down of the defunct Kingdom Bank. 

The law firm last week admitted investigating one of their lawyers Bokani Machinya on the matter and the said lawyer is on suspension pending investigations.
