The government has taken a significant step toward formalising same-sex relations after it moved to amend the Penal Code as it deleted provisions long associated with the criminalisation of consensual same-sex conduct.
According to Statutory Instrument No. 41 of 2026, published in the Government Gazette on March 27, the Attorney General ordered the rectification of Section 164 of the Penal Code Act. The order specifically deletes paragraphs (a) and (c), provisions historically used to criminalise same-sex relations.
